These Terms of Service govern your use of the MzansiFix application and its associated services, operated by KalahariCoding (Pty) Ltd, a company registered in South Africa. By accessing or using MzansiFix, you agree to be bound by these terms.

1. Service Overview

KalahariCoding (Pty) Ltd provides a digital platform to connect users seeking professional and general services with independent tradespeople. The Company does not directly employ tradespeople, nor is the Company responsible for the quality of services rendered by them. All agreements for services are made directly between the user and the tradesperson.

2. User Responsibilities

2.1 Due Diligence

Users are encouraged to exercise due diligence when selecting a tradesperson, including:

Verifying credentials
Checking references
Reviewing past work and ratings
Confirming service details directly with the tradesperson

2.2 Acceptable Use

Users agree not to use the app for any unlawful or prohibited activities. Misuse of the platform, including but not limited to:

Fraudulent bookings
Harassment of tradespeople or other users
Posting false or misleading information
Violating intellectual property rights
Spamming or phishing

Such misuse will result in immediate account termination.

3. Tradesperson Terms

3.1 Registration

By registering as a tradesperson on MzansiFix, you agree to:

Provide accurate and up-to-date information
Maintain professional conduct
Respond to customer inquiries in a timely manner
Honor quoted rates and availability
Comply with all applicable laws and regulations

3.2 Profile Information

Tradespeople are responsible for the accuracy of their:

Service descriptions
Rates and pricing
Service areas
Availability schedules
Contact information
Credentials and qualifications

4. Limitation of Liability

Important: KalahariCoding (Pty) Ltd acts solely as a platform facilitator and does not:

Verify the qualifications or certifications of tradespeople
Guarantee the quality, safety, or legality of services provided
Assume any liability for damages, losses, or disputes arising from services rendered
Act as an employer or agent of any tradesperson

5. Payments and Fees

All financial transactions for services are conducted directly between users and tradespeople. MzansiFix does not process payments or charge commission fees on transactions. Any pricing discussions, quotes, and payment arrangements are the sole responsibility of the parties involved.

6. User-Generated Content

Users may post reviews, ratings, and comments. By posting content, you grant MzansiFix a non-exclusive, royalty-free license to use, display, and distribute such content. You agree that your content:

Is truthful and accurate
Does not violate any third-party rights
Does not contain offensive, defamatory, or inappropriate material

MzansiFix reserves the right to remove any content that violates these terms.

7. Privacy and Data Protection

Your use of MzansiFix is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with South African data protection laws (POPIA).

8. Intellectual Property

All content, logos, trademarks, and materials on MzansiFix are the property of KalahariCoding (Pty) Ltd or its licensors. Users may not reproduce, distribute, or create derivative works without express written permission.

9. Dispute Resolution

Any disputes arising from the use of MzansiFix shall be resolved through:

Direct Communication: Users and tradespeople should attempt to resolve disputes directly
Mediation: If direct resolution fails, parties may seek mediation
South African Law: These terms are governed by the laws of South Africa

10. Account Termination

MzansiFix reserves the right to suspend or terminate accounts that:

Violate these Terms of Service
Engage in fraudulent activities
Receive repeated complaints
Remain inactive for extended periods

11. Changes to Terms

KalahariCoding (Pty) Ltd reserves the right to modify these Terms of Service at any time. Users will be notified of significant changes through the app or email. Continued use of MzansiFix after changes constitutes acceptance of the modified terms.
